Annual Quantity and Emissions Reports Due to California’s SCAQMD April 1

California’s South Coast Air Quality Management District (SCAQMD) has issued a Rule 314 compliance reminder that the submittal deadline for the 2021 Annual Quantity and Emissions Report (AQER) is April 1, 2022.

SCAQMD’s Rule 314 – Fees for Architectural Coatings Manufacturers is intended to recover the district’s cost of implementing the architectural coatings program and programs related to architectural coatings, and mandates that those revenues only be used for such purposes. California Health and Safety Code Section 40522.5 provides authority for the district to adopt a fee schedule on area-wide or indirect sources of emissions which are regulated, but for which permits are not issued by the district, to recover the costs of programs related to these sources.

Rule 314 applies to architectural coatings manufacturers who distribute or sell their manufactured architectural coatings into or within the district for use in the district and are subject to Rule 1113 – Architectural Coatings. Rule 314 also applies to private labelers and big box retailers who distribute or sell architectural coatings into or within the district for use in the district and are subject to Rule 1113. This includes products sold through big-box retailers with distribution centers located within or outside the district. Rule 314 does not apply to architectural coatings sold in SCAQMD for shipment and application outside of that district or to aerosol coating products.

While the 2021 AQER is due April 1, 2022, there is a grace period until May 30, 2022, before penalties apply. Please note that the fee exemptions do not apply to reports received after May 30, 2022 (e.g., recycled coatings, coatings that contain ≤ 5 g/L volatile organic compound (VOC) of material, and the small manufacturer exemption).
